Terms & Conditions

1. You are responsible for providing accurate, complete and updated information while creating or using your account.
2. You must keep your login credentials, OTP and account information confidential.
3. You are responsible for all activities performed through your account.
4. MOBITECH reserves the right to suspend, restrict or terminate an account if any information provided is found to be false, misleading, fraudulent or in violation of these Terms.

When you submit a request to sell or exchange a mobile phone, laptop or other electronic device through MOBITECH:

• The information provided by you regarding the device must be accurate.
• The device must legally belong to you or you must have proper authority to sell it.
• You must not submit a stolen, lost, blocked, financed, leased or otherwise disputed device.
• IMEI/Serial Number and other device information provided by you may be verified by MOBITECH.
• The final purchase/exchange value may depend on the physical condition, functionality, specifications, IMEI verification, market conditions and inspection of the device.
• An online estimated price, quotation or indicative value is not necessarily the final payable amount.

The price displayed or communicated before physical inspection may be an estimated value.

The final value may be revised after inspection if there is any difference in:

• Device model or variant
• Storage/RAM
• Physical condition
• Display or touch condition
• Battery condition
• Camera, speaker, microphone or other hardware
• Water/liquid damage
• Software or functional issues
• IMEI/Serial Number information
• Accessories or original box/bill availability
• Any other discrepancy found during inspection

By submitting a device for sale/exchange, you confirm that:

• You are the lawful owner of the device or are legally authorized to sell it.
• The device is not stolen, lost or unlawfully obtained.
• The device is not subject to any ownership dispute.
• The IMEI/Serial Number has not been intentionally altered, tampered with or manipulated.
• Any information and documents submitted by you are genuine and accurate.

MOBITECH may refuse or cancel a transaction where ownership, authenticity or legality of the device cannot be satisfactorily verified.

MOBITECH may verify the IMEI, Serial Number and other device identifiers through available verification systems, databases, service providers or other lawful sources.

If a device is found to have a suspicious, invalid, duplicated, blocked, blacklisted or otherwise problematic identifier, MOBITECH may reject, suspend or cancel the transaction.

Payment will be processed according to the payment method selected and the applicable transaction process.

Payment may be withheld, delayed or cancelled where additional verification is required or where the transaction is suspected to involve inaccurate information, fraud, ownership issues or violation of these Terms.

MOBITECH may cancel or reject a request or transaction due to:

• Failed verification
• Incorrect information
• Device mismatch
• IMEI/Serial Number issues
• Ownership concerns
• Inspection discrepancies
• Unavailability of the service
• Technical issues
• Fraudulent or suspicious activity
• Violation of these Terms

The customer may also cancel a request before completion of the transaction, subject to the applicable process.

By using the Platform, you consent to MOBITECH contacting you regarding your account, device request, inspection, pickup, payment, cancellation, service updates and other transaction-related matters through applicable communication channels such as SMS, WhatsApp, email, phone call or notifications.

Information provided by you may be collected, processed and used for account management, device verification, transaction processing, customer support, fraud prevention, legal compliance and other legitimate business purposes in accordance with the MOBITECH Privacy Policy.

You must not:

• Provide false or misleading information.
• Attempt to sell a device that does not legally belong to you.
• Manipulate or alter device/IMEI information.
• Use the Platform for fraudulent or unlawful activities.
• Create multiple accounts for abuse of offers or services.
• Attempt to bypass or interfere with the Platform's security or verification systems.
• Upload or submit information belonging to another person without proper authorization.

MOBITECH may modify, update, suspend or discontinue any part of the Platform, services, pricing processes, eligibility criteria or these Terms & Conditions from time to time.

Updated Terms will become applicable once published on the Platform, unless otherwise specified.

MOBITECH shall not be responsible for losses arising from incorrect information provided by the customer, unauthorized use of an account, technical interruptions, third-party service failures or circumstances beyond MOBITECH's reasonable control, subject to applicable law.

These Terms & Conditions shall be governed by the applicable laws of India.

Any dispute arising in connection with the Platform or services shall be subject to the jurisdiction of the competent courts having jurisdiction over the applicable location of MOBITECH, subject to applicable law.
